Before you run a background check on any candidate, you must notify them in writing. This disclosure must be a standalone document—it cannot be buried in an employment application or handbook.
The candidate must then sign an authorization form giving you permission to run the check.
- Rule 1: Keep the disclosure completely separate from other paperwork.
- Rule 2: Obtain a signature (physical or digital) before contacting your screening provider.
2. Partnering with a Verified CRA
Ensure you are using a qualified Consumer Reporting Agency (CRA) that adheres to strict accuracy regulations. Doing informal Google searches or checking social media is not a substitute for a professional screening report and can violate compliance laws.

- Pre-Adverse Action: Send the candidate a copy of the background report, a copy of the "Summary of Your Rights Under the FCRA" document, and a notice explaining that their report is under review. Give them a reasonable amount of time (typically 5 to 7 days) to dispute any inaccuracies.
- Final Adverse Action: If they do not dispute the report, or the dispute is resolved and the report remains accurate, you can send the final notice confirming your decision.
